Is THCA Legal in Nebraska? — 2026 Guide

The short answer

Nebraska adopted LB 657 (2019), the Nebraska Hemp Farming Act, which legalized hemp at the state level but on stricter terms than the federal 2018 Farm Bill. The Nebraska Department of Agriculture’s testing program calculates total THC — the post-decarboxylation figure that adds delta-9 plus 0.877 multiplied by THCA — rather than delta-9 alone. Under that math, a flower batch reading 22% THCA blows past the 0.3% line by orders of magnitude and is treated as marijuana under state law.

The result: high-THCA flower, pre-rolls, and full-spectrum vapes are not realistically retail-legal in Nebraska, even though hemp itself is.

What “Nebraska LB 657” actually says

LB 657 created Nebraska’s hemp licensing program and adopted the federal 0.3% delta-9 THC threshold in statute. The wrinkle is regulatory: the Nebraska Department of Agriculture’s testing protocol (Title 25, Chapter 7) requires hemp to be tested post-decarboxylation, which is the chemistry shorthand for “after THCA has been heated into THC.”

That post-decarb test is the standard the USDA Final Rule requires for cultivators, but Nebraska applies it at the retail product layer too. Plain-English version: if a flower jar has 22% THCA on the COA, the regulator runs the math (22% × 0.877 ≈ 19.3%) and that flower is over the limit by a factor of 60+. Can you legally buy THCA online in Nebraska?

In practice, mostly no. Most reputable national brands have geofenced Nebraska from THCA flower SKUs to avoid liability under the state’s total-THC rule. Some still ship CBD-dominant products, low-potency edibles, and isolate-based gummies where delta-9 stays under 0.3% by both methods. A handful of brands continue to ship THCA flower to Nebraska but explicitly disclaim that the consumer assumes all legal risk — we do not list those.

Second, the federal Farm Bill rewrite. If Congress codifies a total-THC standard nationally, Nebraska’s rule becomes redundant. If Congress instead reaffirms the delta-9 standard, pressure on Nebraska to align grows.
