Under that math, a flower batch reading 22% THCA blows past the 0.3% line by orders of magnitude and is treated as marijuana under state law.
The result: high-THCA flower, pre-rolls, and full-spectrum vapes are not realistically retail-legal in Nebraska, even though hemp itself is.
What “Nebraska LB 657” actually says
LB 657 created Nebraska’s hemp licensing program and adopted the federal 0.3% delta-9 THC threshold in statute. The wrinkle is regulatory: the Nebraska Department of Agriculture’s testing protocol (Title 25, Chapter 7) requires hemp to be tested post-decarboxylation, which is the chemistry shorthand for “after THCA has been heated into THC.”
That post-decarb test is the standard the USDA Final Rule requires for cultivators, but Nebraska applies it at the retail product layer too. Plain-English version: if a flower jar has 22% THCA on the COA, the regulator runs the math (22% × 0.877 ≈ 19.3%) and that flower is over the limit by a factor of 60+. Can you legally buy THCA online in Nebraska?
In practice, mostly no. Most reputable national brands have geofenced Nebraska from THCA flower SKUs to avoid liability under the state’s total-THC rule.
